PERTINENT PROVISIONS OF RELEVANT STATUTES, ORDINANCE AND QUALITY MANUAL SYSTEM ADOPTED BY THE CITY CIVIL REGISTRY DEPARTMENT OF CALAPAN IN ISSUANCE OF BIRTH, MARRIAGE AND DEATH CERTIFICATES.
I. PROCEDURE MANUAL, QUALITY MANUAL, ISO 9001:2008, QUALITY MANAGEMENT SYSTEM
Non-disclosure of Birth Records, likewise, in compliance to Clause 7.5.4: Customer Property of Philippine National Standards (PNS ISO 9001:2008. As a reasonable internal office policy and in order to have uniform, orderly and controlled issuance of Marriage and Death Certificates, the procedure in the issuance of Birth Certificate is likewise adopted in the issuance of Death and Marriage certificates.)
II. ADMINISTRATIVE ORDER NO.1, SERIES OF 1993, IMPLEMENTING RULE AND REGULATIONS OF ACT NO.3753 AND OTHER LAWS ON CIVIL REGISTRATION
Rules 24. Non Disclosure of Birth Records. -(1) The Records of a person's birth shall kept strictly confidential and no information relating there to shall be issued except on the request of any of the following:
a) The concerned person himself, or any person authorized by him; b) His spouse, his parent or parents, his direct descendants, or guardian or institution legally in charge of him, if he is a minor; c) The court or proper public official whenever absolutely necessary in administrative, judicial or other official proceedings to determine the identity of the child's parents or other circumtances surrounding his birth; and d) In case of the person's death, the nearest of kin (N)
Any person violating the prohibition shall suffer the penalty of imprisonment of at least two months or a fine in an amoint not exceeding five hundred pesos, or both in the discretion of the court.
III. CITY ORDINANCE NO.3 SERIES OF 2016 ALSO KNOWN AS "AN ORDINANCE EXEMPTING ALL SENIOR CITIZENS FROM PAYMENT OF BIRTH CERTIFICATE, MARRIAGE CERTIFICATE AND DEATH CERTIFICATE INCLUDING AUTHENTICATION THERE OF IN THE LOCAL CIVIL REGISTRY OF THE CITY OF CALAPAN"
Senior Citizens shall present their senior citizens identification card (ID) issued by the Office of the Senior Ciitizen's Affair (OSCA). Only Senior Citizens who are bona fide residents of the Calapan shall be allowed to avail of the benefits of the ordinance.
In case of securing the authenticated death certificate, only the request from their spouse shall be allowed. The spouse shall present a proof the he/she is the husband/wife of the deceased.
Further, a representative and/or relative of a Senior Citizen can secure the pertinent documents in behalf of the Senior Citizen concerned upon presentationn of a Valid ID and authorization from the Seniuor Citizen together with the senior citizens ID.
